Annual Leave: Volcanic Ash

Q. While on annual leave, our practice secretary was stranded abroad by the volcanic ash cloud and could not attend work as a result. Should these days be considered an extension of annual leave? Are we obliged to pay staff when absent?
A. In view of the airline travel restrictions due to the volcanic ash cloud, it is a matter of discretion on the GP employer's part as to whether they pay for absence from work. There is no legal obligation on the GP employer to pay in this situation, however, an extension of annual leave or unpaid leave could be considered in these circumstances.
